1. Use of Website strictly on the terms set out below
All use of the website www.CarPartsFinder.co.uk (‘the Website’)
is on the terms and conditions below. If you do not agree to these conditions
cease use of the Website immediately. You may print and keep a copy of
these terms. They are a legal agreement between us and can only be modified
with our consent. We reserve the right to change the terms at our discretion
by changing them on the Website.
2. Accuracy of Information and DISCLAIMER

are the trading names Sparefinder . If you find any inaccurate information on the Website
let us know and we will correct it, where we agree, as soon as practicable.
Important our Disclaimer, Warranties and Liability generally are set out
in clauses 7 and 8 below.
3. General
We operate one of the largest UK spare parts network consisting of hundreds
of car dismantlers/ recyclers (‘Network Members’) providing
you with access to literally tens of millions of new and used parts for
all types of vehicles at any given time, most of which are available for
immediate dispatch from our Network Members.
Our Website sets out clearly what information we need from you about
your vehicle and certain personal contact information to enable our Partner
Companies (set out in clause 6 below) to contact you. In some circumstances
we may need to contact you ourselves.
When you make a request for a spare part your request is transmitted
to our Network Members who will check their stock and revert to you if
they can supply you the part. Any contract that you make to purchase any
parts using our Website are with the Network Members direct and not us.
We facilitate communication between you and our Network members through
our Website and the technology behind it- e-mail, SMS text message, telephone,
fax and post.
There is a Frequently Asked Questions section on our Website which sets
out answers to the most frequently asked questions and also provides a
step by step guide to using our Website. Also there is an Important Information
section on our website which sets out some general guidance once you make
a request for a spare part.
4. Information/ Links to other Websites
All information made available to you through our Website (”the
information”) has been supplied to Car Parts Finder Spares by the Network Members
or other third parties that advertise with us, consequently whilst we
agree to use reasonable care in running our Website we do not warrant
that the information provided by our Partner Companies (set out in clause
6 below) is true, correct or complete and further we exclude all the conditions
terms warranties express or implied, statutory or otherwise in respect
of the provision of the information to the fullest extent permitted by
law. We make no representations whatsoever about any other websites which
you may access through our Website or which may link to our Website. When
you access any other website you understand that it is independent from
us and that we have no control over the content or availability of that
website. In addition, a link to any other website does not mean that we
endorse or accept any responsibility for the content, or the use of, such
a website and we shall not be liable for any loss or damage caused or
alleged to be caused by or in connection with use of or reliance on any
content, goods or services available on or through any other website or
resource. Any concerns regarding any external link should be directed
to its website administrator or web master.
You must not use our Website in any way that does not comply with: the
terms of any legislation or in any way that is unlawful You must not do
anything which breaches the security of our Website.
5. Provisions of Service
We will provide access to the Website subject to these terms and we shall
endeavor to ensure that the Website is available 24 hours a day however
we do not accept any liability for our failure to do so. We may for operational
reasons, change the domain names which the Website is made available under;
or suspend the provision of the Website for maintenance or because of
a fault, without giving you any notice. In certain circumstances we may
me be reasonably prevented or hindered to provide you access to the Website
and/ or our Network Members may be unable to communicate effectively with
you through our Website due to circumstances outside our control. Such
circumstances, shall include but not be limited to acts of God, fire,
storm, power shortages, issues with our Bank, Internet Service Provider,
Hosting Provider, relating to connecting to the Internet, server crashes,
deletion, corruption or loss of data. In the event of such circumstances
arising, then we shall use all reasonable endeavors to mitigate the effect
of such circumstances and to carry out such obligations or duties hereunder
in such other way as may be reasonably practicable.
6. Privacy and Information you provide to us
The following applies to any information you provide to us, for example
during your request for a spare part: you authorize us to use, store or
otherwise process any personal information which relates to and identifies
you, including but not limited to your name and address, to the extent
reasonably necessary for our Network Members, our successors (including
the purchaser of the whole or part of our business), associates, sub-contractors
or other third parties (together our ‘Partner Companies’)
to contact you. These Partner Companies may be located in countries outside
the EEA that do not have laws to protect your information. Details of
the companies and countries involved in your case will be provided on
request. If you would like to request such information or review or modify

When you request a spare for any particular vehicle through our Website
then we may collect information about your vehicle and if you send us
or our Network Members personal correspondence such as e-mails then we
may collect this information into a file specific to you (together, the
various purposes set out in this paragraph shall be known as ‘the
Purposes’). All such information collected by us shall be referred
to in these terms as ‘Personal Information’.
You must ensure that the Personal Information you provide is accurate
and complete with your correct name, address and vehicle details, parts
information and other requested details. By using our Website to request
spares, you agree to the processing and disclosure of the Personal Information
for the Purposes. If you would like to review or modify any part of your

7. Warranties and Limitation of Liability
All parts supplied by our Network Members carry a minimum warranty of
30 days. This warranty is provided by the Network members and not us.
In some cases the warranty period may be more and you are advised to clarify
this with the Network Member. You fully accept that we do not warrant,
guarantee, endorse any parts or other products or services offered to
you through our Website by our Network Members. Further, you accept that
we are not a party to the transaction between you and the Network Members.
Any contract that you make to purchase spares will be between you and
our Network Members. To the fullest extent permitted by law, we shall
have no liability whether in contract, tort or otherwise for; direct,
indirect, incidental or consequential damages including loss of profit
whether caused by the supply of the services we provide through our Website
or information set out on our Website. Nothing in these terms shall limit
or exclude our liability to you for death or personal injury caused by
our negligence.
8. Charges/ Condition of Spare Parts/ Returns
You will be pleased to know that the service that we provide to you through
our Website is free of charge if you do not wish to recieve text sms messages.
If you find a spare part that you are looking for through our Network
Members and you want to proceed to purchase the parts then you contract
directly with the Network Members. Our Network Members will confirm to
you whether or not the spare they are supplying is new, used or re-conditioned,
their charges including delivery costs and delivery times and warranty
guarantee details. If you have any questions with regards to the spares
then please ask the Network Members. Check and examine every spare part
that you receive from our Network Members immediately upon receipt and
again before installing/ fitting the same. If there are any discrepancies,
markings, damages, false representations as to condition or quality then
take this up with them immediately.

is and shall remain the exclusive property of Car Parts Finder Spares and/ or our Partner
Companies or other third party licensors.
10. Miscellaneous
If any provision or term set out in these terms shall become or be declared
illegal, invalid, or unenforceable for any reason whatsoever, such term
or provision shall be divisible from the other terms and provisions and
shall be deemed to be deleted from them.
Service of any notice under this Agreement shall be deemed to have been
duly given if it shall have been left at or sent by post to us at our
registered office or in the case of notice to you at an address to which
your provide to us or such address that we can establish form any details
that you provide.
Any delay or failure by us to exercise a right or remedy shall not constitute
a waiver of such rights or remedies and shall in no way affect our right
later to exercise them.
11. SMS messages
Where an SMS text is sent to confirm your mobile number so you may receive
suppliers details and quotes by text on your mobile, a charge is made
if you choose to activate this service and reply back to the short code
"82055" with the word part there is a £5.00 + 1 std txt msg charge
to activate this service for each part request. Chargeable until you text STOP to 82055. By
activating this service does not guarantee you will receive text quotes,
the £5.00 charge is made merely to activate the service for each part request. Once the service has successfully been activated,
all QUOTES will be sent to your mobile on which you have confirmed the
service.
Free Specialist Suppliers details that are sent to you on confirmation of your mobile are specialists for the make you are enquiring about and may not have the vehicle or parts currently you are looking for.
Contacting the Supplier of the provided 070... Number
Callers who phone the suppliers contact number supplied with a part quote
need to be 18 years old or above and have the full permission of the person
who pays the bill. We will not be held responsible for any unauthorized use
of your telephone to access our services as this is out of our control.
Calls to the 070 number placing you directly to the supplier holding your part
are charged at 50p per minute.
Promotions & Marketing
By agreeing to our terms and conditions you agree to accepting offers and promotions with marketing messages direct to your mobile from our network by sms, these are free messages.
12. Law
A person who is not party to these terms shall have no right under the
Contracts (Rights of Third Parties) Act 1999 to enforce any term set out
here. This clause does not affect any right or remedy of any person which
exists or is available otherwise than pursuant to that Act. This agreement
shall be governed by and construed in accordance with the laws of England
and you hereby agrees to submit to the exclusive jurisdiction of the English
courts. |
